TERMS AND CONDITIONS

These Terms and Conditions (“Terms”) govern all quotations, bookings, transportation, moving, delivery, courier, relocation and related services arranged by VanBoys Transport USA (“VanBoys”, “we”, “us”, “our”).

By requesting a quote, making a booking, paying a deposit or using our services, you agree to these Terms.

1. ABOUT VANBOYS TRANSPORT

VanBoys Transport operates as a transportation, logistics, dispatch, booking and marketing platform serving customers throughout Maryland and other states within the United States.

Services may be performed by:

* VanBoys Transport
* Independent contractors
* Owner-operators
* Licensed moving companies
* Courier companies
* Transportation providers
* Third-party subcontractors

2. OUR ROLE

VanBoys may act as a transportation coordinator, dispatcher, booking agent, broker, marketing company or service provider.

By booking through VanBoys, you acknowledge that transportation services may be provided by independent third-party carriers or contractors.

Each carrier may maintain separate:

* Insurance policies
* Coverage limits
* Liability provisions
* Claims procedures

Customers agree that liability relating to transportation services may be governed by the terms of the carrier performing the service.

3. ESTIMATES AND QUOTATIONS

All estimates are based upon information provided by the customer.

Customers must accurately disclose:

* Inventory
* Number of items
* Weight and dimensions
* Access conditions
* Stairways
* Elevators
* Parking restrictions
* Carry distances
* Labor requirements

If actual conditions differ from the information provided, VanBoys reserves the right to:

* Revise pricing
* Add labor charges
* Add vehicle charges
* Reschedule the service
* Decline the service if safety concerns exist

Written estimates shall identify services and applicable charges as required by Maryland law. (Justia Law)

4. BOOKINGS

A booking is confirmed once:

* The booking has been accepted;
* Required deposit payments have been received;
* Scheduling confirmation has been issued.

Customers are responsible for verifying all booking information.

5. DEPOSITS

A deposit may be required to reserve vehicles, drivers, labor and scheduling resources.

Deposits are generally non-refundable because operational costs are incurred immediately upon confirmation.

However, VanBoys may issue a credit note, booking credit or rescheduling option at its sole discretion.

Credits:

* Remain valid for 12 months;
* May be used toward future services;
* Are not redeemable for cash unless required by applicable law.

6. CANCELLATIONS

Customers may cancel at any time.

However:

* Deposits are generally non-refundable;
* Administrative charges may apply;
* Costs already incurred may be deducted;
* Carrier cancellation charges may apply.

If a driver, moving crew, subcontractor or vehicle has already been assigned, additional cancellation fees may apply.

7. RESCHEDULING

Customers may request changes to booking details up to 48 hours before the scheduled service.

Changes requested within 48 hours:

* Are subject to availability;
* May require a revised quote;
* May incur additional charges.

8. WAITING TIME

Customers must ensure access is available upon arrival.

Additional charges may apply for delays caused by:

* Customer absence;
* Delayed access;
* Building restrictions;
* Elevator delays;
* Parking issues;
* Incomplete preparation.

Waiting time may be charged at the applicable hourly rate.

9. PARKING AND ACCESS

Customers are responsible for arranging legal parking and access.

Additional charges may apply where:

* Parking is unavailable;
* Long carry distances exist;
* Special permits are required;
* Additional labor becomes necessary.

Carry distances exceeding approximately 150 feet may result in additional charges.

10. SELF-LOAD SERVICES

Unless specifically included in writing, transportation-only services do not include loading or unloading assistance.

Self-load services require the customer to:

* Load the vehicle;
* Secure items where applicable;
* Unload the vehicle.

Labor assistance must be booked separately.

11. HEAVY OR SPECIALTY ITEMS

Customers must disclose:

* Safes
* Pianos
* Commercial equipment
* Machinery
* Large appliances
* Oversized furniture

Additional labor, equipment or fees may apply.

If items cannot safely be transported using the booked service, customers remain responsible for charges associated with the original booking.

12. PASSENGERS

Transportation services are provided for property and goods only.

Passengers are not permitted in transport vehicles unless expressly agreed in writing.

No passenger seating is included within any booking.

Drivers may refuse passenger travel at any time.

13. PETS AND ANIMALS

VanBoys does not transport pets, livestock or animals.

Customers must arrange separate transportation for animals.

14. PROHIBITED ITEMS

We will not transport:

* Firearms where prohibited by law
* Ammunition
* Explosives
* Hazardous materials
* Illegal substances
* Flammable chemicals
* Biohazardous materials
* Any goods prohibited by federal, state or local law

Customers remain responsible for legal compliance regarding all transported goods.

15. INSURANCE

Insurance coverage may vary depending on the carrier assigned to the booking.

Customers must disclose:

* High-value items
* Jewelry
* Artwork
* Antiques
* Collectibles
* Electronics
* Fragile items

Failure to disclose valuable items may affect available coverage.

Customers are strongly encouraged to obtain independent insurance for valuable or irreplaceable belongings.

16. LOSS OR DAMAGE CLAIMS

Customers should inspect all items immediately upon delivery.

Any visible loss or damage should be reported before accepting delivery whenever possible.

Customers must provide reasonable supporting information, including photographs and documentation.

VanBoys may refer claims to the carrier or service provider responsible for performing the transportation service.

17. PHOTOGRAPHS AND VIDEO RECORDINGS

VanBoys and its contractors may capture photographs and video recordings during:

* Moving services
* Deliveries
* Loading
* Unloading
* Operational activities

Such content may be used for:

* Security
* Insurance
* Training
* Quality control
* Marketing
* Social media
* Promotional purposes

Customers who do not wish media content to be used for marketing purposes must notify VanBoys before the service begins.

18. LIMITATION OF LIABILITY

To the maximum extent permitted by Maryland law, VanBoys shall not be liable for:

* Indirect damages
* Consequential damages
* Loss of profits
* Business interruption
* Emotional distress
* Delays caused by events beyond reasonable control

Nothing in these Terms limits liability where such limitation is prohibited by law.

19. FORCE MAJEURE

VanBoys shall not be liable for delays caused by:

* Severe weather
* Flooding
* Traffic accidents
* Road closures
* Government actions
* Labor disputes
* Natural disasters
* Public emergencies

20. GOVERNING LAW

These Terms shall be governed by the laws of the State of Maryland.

Any legal dispute shall be brought exclusively in the state or federal courts located in Maryland.
